Who Must Be Tested?

Any CDL driver who regularly drives a Commercial Motor Vehicle (CMV) or performs safety-sensitive functions for their company must be placed in a DOT random testing pool. Non-CDL drivers may not be placed in a DOT random testing pool, but employers are free to require separate random drug tests for their non-CDL employees.

Random Selection

The employee selection process for a DOT-compliant random drug testing progam is designed to ensure fairness and impartiality. Employees are chosen using a scientifically random selection method, ensuring that everyone has an equal chance of being selected for testing. This process is conducted through a computer-generated random algorithm, which guarantees true randomness and eliminates any potential bias in the selection process. Drivers are selected quarterly at the beginning of each quarter, with selection dates occurring on January 1st, April 1st, July 1st, and October 1st. In compliance with DOT regulations, 50% of the pool is required to undergo drug testing annually, while 10% must be tested for alcohol.

What Must a Driver Do When Selected for Random Testing?

When a driver is selected for random testing, they will be notified. Once notified, that driver must report to a testing location immediately.

Penalties for Non-Compliance

Failure to comply with DOT random drug testing can result in severe repercussions. These can include fines, penalties, and in some cases, the potential loss of operating authority. Penalties for non-compliance can vary from hundreds to tens of thousands of dollars per violation, based on the seriousness and recurrence of the non-compliance.
